Cardholder Agreement

This covers the card itself: how a purchase reaches your wallet, what you are charged, what you can dispute, and the one thing about a blockchain payment that a bank card does not have to tell you.

Effective Jan 2026. It applies alongside the Terms of Service. Where the two conflict on something about the card, this document governs.

1. Who you are contracting with

There are two of us, and the difference matters when something goes wrong.

  • Our Partners issues the card. They are the licensed issuer, they hold the relationship with Visa, and the card remains their property. Card scheme rules — including your chargeback rights — run through them.
  • NexusPay (NexusPay) is the programme manager. We build the software, connect the card to your wallet, and provide your support.

Our Partners may have their own cardholder terms, which apply in addition to this agreement:

2. The card

  • It is a virtual Visa card. There is no plastic card.
  • It is denominated in USD. Purchases in another currency are converted at the rate the card scheme applies on the day of settlement. We add no markup to that rate.
  • It is issued to you personally and may not be transferred or sold.

3. Where the money comes from

This is the part that differs from every card you have used before. There is no balance to load, and no account holding your money. The card spends the USDT sitting in your own TRON wallet, at the moment you use it.

What makes that possible is the TRC20 allowance you approved when you got the card:

  1. You present the card. The merchant asks Visa to authorise the amount.
  2. We check that your wallet holds enough USDT and that your remaining allowance covers the amount plus our 4.5%.
  3. If both are true, the authorisation is approved and the corresponding USDT is transferred out of your wallet to settle it.

Two consequences follow directly:

  • You must keep enough USDT in the wallet. Moving it elsewhere, even minutes before a purchase, will cause a decline.
  • Revoking the allowance stops the card. That is the correct emergency action if you believe something is wrong, it takes effect immediately, and it does not require us.

4. What the card costs

Charge Amount
Commission on a purchase 4.5% of the purchase amount
Issuing the card Nothing
Monthly or annual fee Nothing
Foreign currency markup added by us Nothing
Inactivity, replacement, closure Nothing
TRON energy for your approval transaction Nothing — we rent it and delegate it to your wallet

That table is the complete list. If a charge is not on it, it does not exist. A purchase of 100 USDT draws 101.50 USDT from your wallet, and you see that figure before you confirm.

Charges by others are still yours: an ATM operator's own fee, a merchant's surcharge, and network fees on transactions you send yourself.

5. Limits

  • US$1,000 per day without an identity check. Above that, verification is required before further spending, as described in the Terms.
  • Your own allowance is also a limit, and usually the one you will meet first. You set it and you can change it.

We may lower a limit where we are required to or where we reasonably suspect fraud, and we will tell you when we do.

6. Why a purchase declines

Most declines are one of these, and the app will tell you which:

  • not enough USDT in the wallet;
  • the remaining allowance is smaller than the amount plus commission;
  • a limit in section 5 has been reached, or verification is outstanding;
  • the merchant is in a prohibited category, listed in section 8;
  • TRON congestion prevented settlement in time;
  • the issuer's or Visa's systems were unavailable.

7. What you are responsible for

  • Your keys. Anyone holding your seed phrase can spend your USDT entirely outside the card. We cannot recover keys and cannot reverse what they do. Never give them to anyone, including someone claiming to be NexusPay support.
  • Your card details. Treat the number, expiry and CVV as you would a plastic card's.
  • Telling us quickly. Report a card you believe is compromised to support@nexusdigitap.com as soon as you know. Revoke the allowance first — that stops the bleeding immediately; telling us starts a process.
  • Keeping your contact details current, so we can reach you.

8. Where the card cannot be used

The card programme blocks some merchant categories. You also agree not to use the card for anything unlawful where you are, or for your own business's payment processing.

9. Unauthorised and disputed transactions

For a card transaction — a merchant charged you twice, took payment for goods that never arrived, or someone used your card details without permission — you have the chargeback rights the Visa scheme gives you. Contact support@nexusdigitap.com within 24 hours of the transaction appearing, and we will raise it with our issuing partners, who decides it under the scheme's rules. Where a dispute succeeds, the amount is returned to your wallet along with our 4.5% on it.

For a transfer on the chain, it is different, and you should know this before you need it. A USDT transfer made under an allowance you granted is final when the block confirms. There is no mechanism in TRON to reverse it, and none we could build. That includes a transfer made by someone who obtained your keys, and a transfer to an address you entered incorrectly.

So: the card layer has consumer protections much like any Visa card. The wallet layer has none. The allowance you set is what bounds the second one.

10. Cancelling the card

You can cancel at any time, from the app or by revoking the allowance. Revoking is immediate and needs nobody's cooperation. Any transaction already authorised will still settle.

We or our issuing partners may suspend or cancel the card where required by law or the scheme's rules, on reasonable suspicion of fraud or unlawful use, or where you have broken this agreement or the Terms. We will tell you, and why, unless the law prevents us.

Cancelling the card does not touch the USDT in your wallet. It was never ours and never moved.

11. Risks specific to this card

  • USDT is not a dollar and is not insured. No deposit guarantee scheme covers it. If it loses its peg, the buying power of your balance falls with it.
  • Tether can freeze an address. The issuer of USDT can block transfers from a particular address, including yours, without notice to us and without our being able to prevent or reverse it.
  • A standing allowance is a standing exposure up to the amount you approved. Set it to what you are willing to have at risk.
  • Chain conditions can stop the card working even when your balance is fine.

12. Changes and contact

We may change this agreement with at least 7 days notice except where a change is required immediately by law or the card scheme. Continuing to use the card after a change takes effect means you accept it; if you do not, cancel the card under section 10.

Support and disputes: support@nexusdigitap.com. Complaints: legal@nexusdigitap.com. This agreement is governed by the law of kenya.
